Behind on taxes

I didn't file, and I'm owed a refund. Is it too late?

You have three years to claim it. Your 2023 refund is still yours until April 15, 2027. No late penalty when you're owed. Here's how to get it back.

Lots of people skip a year when they think they don't owe anything. Usually they're right, and it gets worse: they were owed money. Taxes came out of every paycheck, and the IRS is holding the extra until you ask for it. You can still ask, but not forever.

The three-year window

To get a refund, you have to file within three years of the year's original due date. After that, the money goes to the U.S. Treasury for good.

  • 2023 returns: you have until April 15, 2027.
  • 2024 returns: until April 15, 2028.
  • 2025 returns: until April 15, 2029.
  • 2022 and earlier: the window for those refunds has closed.

There's no penalty for filing late if you're owed

The late-filing penalty is a percentage of tax you owe. If you're owed a refund, there's nothing to charge it on. Filing late for a refund costs you nothing except the time the IRS had your money.

How to claim it

  1. 01Get your W-2s. If you lost them, your free IRS Wage & Income transcript at irs.gov lists every W-2 and 1099 that was filed for you, for up to ten years back.
  2. 02File that year's return on that year's form. Old returns can't be e-filed by most software and are usually mailed.
  3. 03Wait. Paper returns for back years often take 6 to 12 weeks or more. You can track them with Where's My Refund on irs.gov.

Things that can hold up or shrink the refund

  • Missing later years. If you're also behind on a more recent year, the IRS can hold the refund until that one is filed.
  • Old debts. The refund can be applied to back taxes, past-due child support, or federal student loans first.
  • Credits you may have missed. If you had low income that year, the Earned Income Tax Credit can make the refund much larger than your withholding. It's claimed on the same late return.

Not sure you're owed?

You don't need to know before you start. Pull the transcript, and the withholding on it tells you most of the answer: if your income was modest and taxes came out of your pay, you were probably owed.

Claim it before the window closes.

Tell us the years you missed. We show you how to get your W-2s from your free IRS transcript, build each year's return, and you sign and mail it. $99 a year, and you see the refund before paying anything.
